Privacy Policy

These policies (hence forth, the “Policies”) condition the use of the web page  www.cnzfe.gob.do (hence forth, the “Page”) National Free Council  (CNZFE) (hence forth, the “CNZFE”), autonomous, decentralized, public institution created by the enactment of Law No. 8-90.

  1. Conditions.
    1. In order to use the services which require gathering of personal information on the part of the "CNZFE" through the Page, minors must obtain prior permission from their parents, tutors or legal guardians, who will be held liable for all acts carried out by the minors under their tutelage.
    2. You have the obligation to properly use the Page and its services. – The User agrees to use the Page and its services according to the law, the current Policies, the Terms of Use, the Special Conditions of certain services, and other published notices or instructions, as well as the public order, morals, and generally accepted good behavior.
    3. The User must refrain from obtaining or trying to obtain Content through means  other than those that have been made available, have been indicated on other available web pages where the content is located, or those generally used on the Internet, as long as they pose risk of harm or page malfunction, or damage to the services and/or content.
    4. The User or third party recipients of undesired or unsolicited mass mail can communicate it to the official Government Organism by sending an e-mail to the following address: webmaster@cnzfe.gob.do.
  2. Non license.
    1. All brands, commercial names, or distinctive symbols of any kind that appear on the Page, are the property of the Government Organism or third parties, without implying any right of ownership over these to the User, simply because of access or use of the Page.
    2. Likewise, all content is the intellectual property of the CNZFE or of third parties, without relinquishing rights to the User, as established in these policies, none of the rights of use that exist or might exist over said content beyond the strictly necessary for the proper use of the page and its services, in other words, the User may consult, copy, and store in his hard drive or any other physical device, print or copy available material from the Page, Exclusively for his personal or private use, or that carried out in his company or organization, mentioning at all times the government’s ownership over the material, and being strictly prohibited to alter, modify, or break down its content.
    3. It is strictly prohibited to sell in any way or under any title the contents within the Page, without previous written authorization from the Government Organism. This Page may contain information from other sources, and in these cases, it may be necessary to get consent from them before reproduction.
  3. Limitations on warrantee and liability.
    1. Availability and continuity, usefulness and fallibility.-The CNZFE does not guarantee the availability and continuity in terms of Page operation and its Services. When reasonably possible, the Government Organism will give previous warnings as to the interruption of the Page and its services. The Government Organism, also, does not guarantee the usefulness of the Page and of the Services to carry out any concrete activity, nor its infallibility and in particular, and not exclusively, that the User may effectively use the Page and the Services, or access other pages that offer services.
    2. THE CNZFE IS NOT LIABLE FOR DAMAGES OR LOSS OF ANY NATURE RESULTING FROM THE LOSS OF AVAILABILITY OR CONTINUITY IN FUNCTIONING OF THE PAGE AND THE SERVICES, TO THE DETRIMENT IN USEFULLNESS THAT THE USER MIGHT HAVE ATTRIBUTED TO THE PAGE AND/OR THE SERVICES, TO THE FALLIBILITY OF THE PAGE AND/OR THE SERVICES, AND IN PARTICULAR, AND NOT EXCLUSIVELY, FAILURE TO ACCESS DIFFERENT WEB PAGES THROUGH THE PAGE OR THOSE THAT OFFER THE SERVICE.
    3. Privacy and security when using the Page and the Services. – The Government Organism does not guarantee privacy and security when using the Page and the Services and, in particular, does not guarantee that non authorized third parties may have knowledge of the kind, conditions, characteristics, and circumstances of portal and Service use by the Users.
    4. Quality. – The Government Organism does not control or guarantee the absence of viruses nor other elements in content that may alter your computer system (software and hardware) or in electronic documents or files stored in your computer system.
    5. Veracity, exactness, and updated content. – THE CNZFE IS NOT LIABLE FOR ANY DAMAGES, OR LOSS OF ANY NATURE RESULTING FROM LACK OF VERACITY, EXACTNESS AND/OR UPDATED CONTENT.
    6. Permissibility, reliability and usefulness. – The CNZFE does not guarantee permissibility, reliability, and usefulness of services given by third parties through the Page. THE CNZFE IS NOT LIABLE FOR DAMAGE OR LOSS  OF ANY NATURE RESULTING FROM THE SERVICES GIVEN BY THIRD PARTIES THROUGH THE PAGE.
  4. Procedure in case of materialization of activities illicit in nature.
    1. In the case that any User or third party believes there are facts or circumstances that reveal the illicit nature of  any content use and/or the carrying out of activities among the included web pages or accessible through the Page, and, in particular, of the violation of intellectual property rights or other rights,  a notification should be sent to the CNZFE in which the following are stated:
      1. Personal information of the person making the complaint: name, cedula number (or passport, in case of foreigners), address, phone number and e-mail address;
      2. Specification of supposed illicit activity taking place on the page and, in particular, when its related to a copyright violation, precise and concrete indication of the protected content  as well as their location on the Web pages;
      3. Facts or circumstances which reveal the illicit nature of said activity;
      4. In the case of supposed copyright violations, hand written signature or equivalent, with the personal information of the injured party or authorized person to act on his behalf;
      5. Clearly stated declaration, with assurance from the claimant that the provided information is exact and illegal in nature from the standpoint of content or from the execution of the activities described.
  5. Notices.

All notices or communications (hence forth the “NOTICES “) On behalf of the User to the CNZFE  are considered effective, for all purposes, when they are sent to us by messenger to the following address: Leopoldo Navarro 61 Avenue, 5th. Floor of San Rafael, Santo Domingo, D.N. Dominican Republic.

  1. Applicable legislation.
    1. The present policies obey in their entirety the laws of the Dominican Republic.
  2. Jurisdiction.
    1. The CNZFE and the User, with implied waiver to any other jurisdiction, submit to the courts of the Dominican Republic.
